These Terms and Conditions form the basis on which you may use the services of Shika Trends Ltd ("Shika Trends", "we", "our" or "us").

Shika Trends provides business solutions, event services, rental services and other products and services.

By booking, purchasing, registering for, hiring or otherwise engaging our services, you agree to be bound by these Terms and Conditions.

1. Formation of Contract

1.1 A legally binding contract between Shika Trends Ltd and the customer may be formed when we accept a booking, order, service request or instruction.

1.2 Bookings and instructions made online, by email, WhatsApp, telephone, in person or through other agreed communication channels may form part of the contract.

1.3 A quotation, proposal, Registration Package, invoice, booking confirmation or other written communication may set out the specific service, price and requirements applicable to your engagement.

1.4 Where you provide verbal or electronic instructions and we accept and act upon those instructions, they may form part of the agreement between us.

1.5 An enquiry or general discussion does not, by itself, create a contract.

1.6 We may retain relevant communications and records relating to your booking or service.

2. Services Provided

2.1 Shika Trends provides, but is not limited to:

  • Event planning and coordination
  • Event management
  • Event styling and décor

  • Customised sashes and related event wear

Rentals

  • Event equipment
  • Décor
  • Furniture
  • Accessories
  • Other items available for hire

2.2 Customised sashes and other personalised products supplied by Shika Trends are classified as Event services/products.

2.3 We reserve the right to amend, update, improve, withdraw or substitute services where necessary.

3. Pricing and Fees

3.1 Our prices vary depending on the service and will be communicated through the applicable Registration Package, quotation, proposal, invoice, booking confirmation or service agreement.

3.2 Our fees may change from time to time.

3.3 A confirmed booking or service will normally retain the agreed price unless additional services, changes or requirements are requested or otherwise agreed.

3.4 Additional charges may apply where the customer requests additional work, products, equipment, delivery, collection, changes or other services outside the original agreement.

3.5 Where applicable, taxes, delivery charges, third-party costs or other additional charges will be communicated as part of the applicable service or booking.

4. Payment Terms

4.1 Payment may be required in full or in part before services, bookings, orders or rentals commence.

4.2 Where an invoice is issued, the payment deadline stated on the invoice will apply.

4.3 We reserve the right to suspend or delay services, bookings, deliveries, rentals or other work where payments are overdue.

4.4 The customer remains responsible for any outstanding balance arising under the agreed service or booking.

5. Non-Refundable Payments

5.1 Unless otherwise stated or required by applicable law, payments made to secure, register for, activate, reserve or commence a service or booking are non-refundable.

5.2 This may include registration fees, deposits, booking payments, advance payments, consultation fees and payments relating to customised or personalised products or services.

5.3 Payments may be used to allocate staff time, reserve availability, purchase materials, engage suppliers, commence preparation or otherwise begin work relating to the service.

5.4 Cancellation of a service or booking does not automatically create a right to a refund.

5.5 Nothing in these Terms and Conditions excludes or restricts any statutory right to a cancellation, refund or other remedy which cannot legally be excluded or restricted.

6. Refunds Agreed by Shika Trends

6.1 Shika Trends may, at its discretion and where legally permitted, agree to provide a refund even where a payment would otherwise be non-refundable.

6.2 Approval of a refund does not mean that the funds will be returned immediately.

6.3 Before processing a refund, we may verify the relevant payment, booking and customer details and reconcile any applicable accounting, supplier or operational costs.

6.4 Where no shorter refund period is required by applicable law, Shika Trends may take up to 180 working days from the date of approval to complete a discretionary refund.

6.5 Refunds will normally be made using the original payment method.

6.6 Once a refund has been processed by Shika Trends, the time taken for the funds to appear in the customer's account will depend on the relevant bank, card provider or payment processor.

6.7 Where applicable law requires a refund to be made within a shorter period, the applicable statutory timeframe will take precedence over this section.

7. Cancellation, Rescheduling and Changes

7.1 Cancellation terms may vary depending on the service.

7.2 Where specific cancellation terms have been provided in a Registration Package, quotation, booking confirmation, invoice or service agreement, those terms will apply.

7.3 Requests to reschedule or change a service or booking are subject to availability and may incur additional charges.

7.4 For customised or personalised products, including customised sashes, cancellation or amendment may not be possible once production or preparation has commenced, subject to applicable law.

7.5 Customers should notify Shika Trends of cancellations or requested changes as soon as possible.

8. Events and Customised Products

8.1 Customers booking event services are responsible for providing accurate information including event dates, venue details, timings, quantities and specifications.

8.2 Customers ordering customised or personalised products are responsible for checking and approving names, spelling, wording, colours, sizes, quantities and designs before production.

8.3 Once production has commenced, changes may not be possible and additional costs may apply.

8.4 Where venue access, delivery, collection, set-up or dismantling is required, customers must provide the necessary access and information within the agreed timeframe.

9. Rental Services

9.1 Unless otherwise agreed, all rental items remain the property of Shika Trends.

9.2 Customers are responsible for rental items while they are in their possession or control.

9.3 Rental items must be used appropriately and returned within the agreed hire period and in reasonable condition, allowing for normal wear and tear.

9.4 Customers may be responsible for reasonable repair or replacement costs arising from loss, theft, damage, misuse or failure to return rental items.

9.5 Any security deposit or other rental conditions will be stated in the applicable booking documentation.

10. Customer Responsibilities

10.1 Customers must:

  • Provide accurate and complete information;
  • Provide requested information within the required timeframe;
  • Make payments when due;
  • Follow reasonable instructions relating to the service; and
  • Notify us promptly of relevant changes.

10.2 We are not responsible for delays, additional costs or other consequences resulting from inaccurate information, late information or failure to cooperate.

11. Consultancy and Advisory Services

11.1 Our consultancy and advisory services are provided based on the information available to us and the scope of the service purchased.

11.2 Unless expressly agreed otherwise, we do not guarantee a particular outcome.

11.3 Where an outcome depends on a government authority, educational institution, employer, supplier, venue or other third party, the final decision remains outside our control.

11.4 Where specialist legal, financial, tax or other regulated advice is required outside our service scope, customers should obtain advice from an appropriately qualified professional.

12. Third-Party Services

12.1 We may use third-party suppliers, contractors, manufacturers, couriers, venues and other service providers where required to deliver our services.

12.2 We are not responsible for delays, cancellations or failures caused by third parties where those circumstances are outside our reasonable control.

12.3 Where a customer separately contracts with a third party, that provider's own terms and conditions may apply.

13. Intellectual Property

13.1 Unless otherwise agreed in writing, all Shika Trends branding, designs, documents, templates, graphics, photographs, written materials and other intellectual property remain the property of Shika Trends or the relevant rights holder.

13.2 Our materials may not be copied, reproduced, distributed or commercially used without our written permission.

14. Data Protection

14.1 Shika Trends processes personal information in accordance with applicable UK data protection legislation.

14.2 Personal information may be used for service delivery, administration, bookings, payments, communication, customer support, legal compliance and other legitimate business purposes.

15. Liability

15.1 We will provide our services with reasonable care and skill.

15.2 Nothing in these Terms excludes or limits liability where doing so would be unlawful.

15.3 Subject to applicable law, we are not liable for indirect or consequential losses, loss of profits, loss of business or loss of opportunity that was not reasonably foreseeable.

15.4 We are not responsible for losses caused by inaccurate information supplied by the customer, failure to follow reasonable instructions, failure to meet agreed deadlines or decisions made by third parties.

16. Force Majeure

16.1 We will not be responsible for delays or failure to provide services caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, government restrictions, strikes, transport disruption, venue closure, supplier failure or significant technical failures.

16.2 Where reasonably possible, we will notify affected customers and take reasonable steps to minimise disruption.

17. Complaints

17.1 If you are dissatisfied with our service, please contact us as soon as reasonably possible.

17.2 Complaints should include your name, relevant booking or invoice details and details of the issue.

17.3 We will review complaints fairly and seek to resolve them within a reasonable timeframe.

18. Suspension or Termination

18.1 We may suspend or terminate services where:

  • Required payments are not made;
  • The customer materially breaches these Terms;
  • Fraudulent or materially misleading information is provided;
  • The customer repeatedly fails to cooperate;
  • Conduct towards our staff, contractors or representatives is abusive or threatening; or
  • Continuing the service would create a legal, regulatory, safety or operational concern.

18.2 Any financial consequences will be dealt with in accordance with the applicable service terms and applicable law.

19. Consumer Rights

19.1 If you are a consumer, nothing in these Terms is intended to remove or restrict rights provided to you under UK consumer law.

19.2 Where a statutory cancellation, refund or other consumer right applies, that right will take precedence over any conflicting provision in these Terms.

20. Amendments

20.1 Shika Trends may amend these Terms and Conditions from time to time.

20.2 The latest version will be published on our website.

20.3 The version applicable to a new booking or engagement will normally be the version in force when the contract is formed.

21. Governing Law

21.1 These Terms and Conditions are governed by the laws of England and Wales.

21.2 Subject to any applicable statutory rights, disputes will be subject to the jurisdiction of the courts of England and Wales.
